The machinegun is an M1895 Colt-Browning, commonly referred to as the "potato digger" because the mechanical linkage of its operating mechanism dropped below the gun when it was fired and could dig up the ground if the gun was mounted too low. The tripod had a sort of bicycle seat on its rear leg. The gunner appears to be sitting on that seat. The gunner is most likely a US Marine, as the US Army never "officially" procure the M1895.
